Terms and Conditions

These Terms govern access to and use of SCUBIS cloud storage, files, photos, synchronization, backup, sharing, communication and related services.

Last updated: 28 September 2026

1. About SCUBIS and acceptance

These Terms and Conditions are a legally binding agreement between you and “СКУБИС” OOD (SCUBIS), UIC 206621197, a limited liability company registered in the Republic of Bulgaria (“SCUBIS”, “we”, “us”).

They apply to visitors and registered users of SCUBIS websites, web applications, mobile and desktop applications, APIs and related services (the “Services”). By creating an account, purchasing a subscription or using the Services, you agree to these Terms.

2. Eligibility, registration and account security

You must have legal capacity to enter into these Terms. If you use SCUBIS for an organization, you confirm that you are authorized to act for it. You must provide accurate account information and are responsible for keeping credentials and devices secure. Notify us promptly if you suspect unauthorized access.

You may not impersonate another person or use multiple accounts to circumvent storage, trial, security or usage limits.

3. Your files and data

You retain ownership of your files and data. These Terms do not transfer ownership of your content to SCUBIS.

You grant SCUBIS only the rights reasonably necessary to provide the Services you request, including hosting, storing, copying for redundancy or backup, transmitting, generating previews, indexing, organizing, synchronizing, restoring and sharing data according to your instructions.

You represent that you own, or have the necessary rights to store, process and share, content you place in SCUBIS.

Backups and synchronization

Synchronization is not the same as an independent backup. Depending on the selected mode, deletion or modification on one device may propagate to other devices or server copies. Version history, recycle bins, archive modes and external backup destinations may have separate retention limits. For irreplaceable data, maintain an additional independent copy.

4. SCUBIS Services

The Services may include SCUBIS Drive/Files, SCUBIS Photos, synchronization clients, backup tools, shared folders and links, media playback, mail, AI-assisted features and other SCUBIS modules. Availability may depend on plan, device, operating system, region and product version.

We may improve, replace or discontinue individual features where reasonably necessary, subject to mandatory consumer rights and legally required notice.

5. Plans, storage limits, subscriptions and payments

SCUBIS may offer free and paid plans with different storage quotas, features and limits. Current prices and material conditions are presented in the Service at purchase. Taxes may be added where required.

Paid subscriptions may renew automatically for the billing period selected until cancelled. If an account exceeds its storage quota, new uploads, synchronization or backups may be restricted until usage is reduced or the plan is upgraded.

Consumer rights

If you are a consumer in the European Union or another jurisdiction granting mandatory consumer protections, nothing in these Terms limits those rights. Statutory withdrawal, conformity, remedy and refund rights apply where required by law.

6. Sharing and authorized access

When you share files, folders, albums or other content, you are responsible for selecting recipients and permissions. Anyone with access may be able to view, download or copy shared content. Revoking access cannot recall copies already downloaded.

7. Acceptable use

You must use SCUBIS lawfully. You must not upload or distribute unlawful or infringing content; distribute malware; conduct fraud, phishing, spam, harassment or unauthorized surveillance; attempt unauthorized access; circumvent quotas or security controls; intentionally overload infrastructure; or resell the Services without authorization.

We may investigate credible abuse reports and take proportionate measures, including restricting sharing, suspending access or removing content where required or permitted by law.

8. Cancellation, suspension and termination

You may stop using SCUBIS and cancel paid subscriptions through available account or billing controls. Cancelling a subscription does not necessarily delete the account or stored data.

You may request account deletion through available controls or by contacting SCUBIS. Download data you wish to retain before deletion. Limited records may be retained where required for legal, security, fraud-prevention, accounting or dispute purposes.

We may suspend or terminate access where reasonably necessary because of material breach, unlawful activity, security risk, non-payment, infrastructure abuse or legal requirement.

9. Service availability

We design SCUBIS for reliable operation, but no online storage service can guarantee uninterrupted availability or absolute protection against every hardware failure, software defect, network outage, malicious act or force-majeure event. We may perform maintenance and security updates.

10. Intellectual property

SCUBIS and its licensors retain rights in the Services, software, designs, trademarks and documentation, except user content and third-party components governed by their respective licenses. Open-source components remain governed by their applicable open-source licenses.

11. Warranties and limitation of liability

The Services are provided subject to warranties and remedies that cannot legally be excluded. To the maximum extent permitted by law, SCUBIS does not guarantee that every feature will be uninterrupted, error-free or compatible with every device or file format.

To the maximum extent permitted by law, SCUBIS is not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed, or for loss caused by circumstances outside our reasonable control. Nothing excludes liability where exclusion is prohibited by law.

12. Privacy and personal data

SCUBIS processes personal data in accordance with applicable data-protection law, including the GDPR where applicable. A separate SCUBIS Privacy Policy will describe categories of personal data, purposes, legal bases, retention, recipients, transfers and data-subject rights. These Terms do not replace that Privacy Policy.

13. Changes to these Terms

We may update these Terms to reflect changes in the Services, law, security requirements or business operations. The current version and effective date will be published here. Where legally required, material changes will be notified in advance.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Bulgaria, without depriving consumers of mandatory protections provided by the law of their country of habitual residence where applicable.

We encourage users to contact us first to resolve disputes directly. Courts with jurisdiction under applicable Bulgarian and European Union law may hear disputes. Nothing requires an EU consumer to waive mandatory rights concerning jurisdiction or legal remedies.

15. Company and contact information
